Small Business Defends “Two-for-One” Executive Order on Regs

The National Federation of Independent Business (NFIB) has filed an amicus brief in support of President Trump’s executive order requiring two regulations to be repealed for every new one imposed.

“We view the executive order as critically important for small businesses, as a way to eliminate unnecessary and outdated regulations that erode their profitability and hamper the economy,” said Karen Harned, Executive Director of the NFIB Small Business Legal Center.

A coalition of progressive groups sued to block the executive order shortly after the President signed it. They argue that the President does not have the legal authority to limit regulation in such a way, a theory that NFIB says is flat-out wrong.

“The order merely builds on a long and bipartisan history of executive orders that directs agencies to carefully consider the costs of new regulations and to review the effectiveness of existing regulations,” said Harned. “The President has the obvious legal authority to create an incentive for regulatory agencies to produce fewer unnecessary rules.”
