U.S. District Court Dismisses Challenge to Two-for-One Executive Order Washington, D.C.

The National Federation of Independent Business (NFIB) commends the U.S. District Court for dismissing a challenge to President Trump’s two-for-one executive order on regulations, which requires federal agencies to eliminate two regulations for every new regulation imposed. This Executive Order has already helped reduce the burden of onerous and costly regulations for small business owners.

“Over-regulation has been a constant problem for small business owners,” said Karen Harned, Executive Director of the NFIB Small Business Legal Center. “The Trump administration has already exceeded the commitment of the two-for-one executive order – eliminating twenty-two regulations for every new regulatory action – providing small businesses much-needed relief from unnecessary and outdated regulations. We believe this Executive Order is an appropriate and rational response to the problem of over-regulation that small businesses face daily, and we are pleased that the U.S. District Court has dismissed this challenge.”

NFIB filed an amicus brief previously with industry groups to defend the two-for-one executive order following a lawsuit from a coalition of progressive groups aimed at blocking this rule. In it, the groups claimed that President Trump did not have the legal authority to limit regulations. NFIB argued that the two-for-one policy advances the goal of sensible regulation by requiring agencies to consider the cost and benefits for old and new regulations.

The NFIB Small Business Legal Center protects the rights of small business owners in the nation’s courts. NFIB is currently active in more than 40 cases in federal and state courts across the courts across the country and in the U.S. Supreme Court.
